Administration’s Recent Actions Severely Weaken Protections and Eliminate Resources for People Facing Housing Discrimination (July 2, 2025)

July 2, 2025 — The Fair Housing Act’s mandate to affirmatively further fair housing is being systematically weakened by administrative actions that prioritize deregulation over established civil rights protections.

By canceling grants for nonprofit investigators who handle the majority of housing complaints and reducing HUD staffing, the government is dismantling the infrastructure necessary to address discrimination against people with disabilities, race-based exclusion, and familial status bias. A new rule effective in 2025 replaces substantive civil rights analysis with a perfunctory "check-the-box" exercise, which risks exacerbating residential segregation and housing shortages. Furthermore, the termination of contracts for inclusive technical assistance and the elimination of the Equal Access Rule leave marginalized people, particularly trans and nonbinary individuals, more vulnerable to homelessness and violence. These shifts represent a significant retreat from the federal duty to ensure equitable access to stable housing, threatening the long-term stability of families and communities.
