May 15, 2025 — Buried in the House version of the OBBB was a 10-year moratorium on state and local AI regulation — which would have nullified existing bans on algorithmic rent-setting in California, New York, Philadelphia, and elsewhere.
Companies like RealPage use these algorithms to coordinate rent levels across multiple landlords; multiple state attorneys general have sued, calling it illegal price-fixing collusion. The provision was stripped by the Senate under broad bipartisan pressure — but the administration pursued the same goal through a December 2025 executive order targeting state AI regulations. Separately, Trump's DOJ quietly settled the federal RealPage prosecution with no fines and no admission of guilt. The tools used to inflate rents on millions of apartments remain in operation, increasingly shielded from accountability.
