These proposed rules respond to industry requests for long-term authorizations that cover the accidental harassment of polar bears and walruses through 2031. While government officials and energy companies expect the actual impact on animal populations to be negligible, the policy acknowledges risks such as aircraft-induced stampedes and den abandonment. Environmental advocates argue that these measures pose an unnecessary threat to vulnerable species already struggling with the effects of climate change. This regulatory shift reflects a broader effort to expand energy extraction in the Arctic by reducing legal barriers for major petroleum corporations.
The Obama, first Trump, and Biden administrations also issued "incidental take" regulations for drillers in the area — none of which allowed polar bears and walruses to be killed. So "incidental take" rules themselves aren't new; what is new is that this version explicitly acknowledges lethal take as a possible outcome, which previous rules did not. That is a meaningful change.
